Phân biệt thuốc và thực phẩm chức năng nhanh qua số đăng ký
💊Thuốc là sản phẩm có tác dụng điều trị, phòng và chẩn đoán bệnh, Trước khi lưu hành phải được Cục Quản lý Dược – Bộ Y tế thẩm định và cấp số đăng ký lưu hành (SĐK). Số đăng ký thuốc giúp xác định tính hợp pháp và nguồn gốc của sản phẩm.
Cấu trúc SĐK thuốc thường gặp gồm: VN-######-xx (thuốc sản xuất trong nước), VD-######-xx (thuốc kê đơn) hoặc mã tương tự tùy loại sản phẩm
Thực phẩm chức năng có tác dụng hỗ trợ sức khỏe, không điều trị bệnh và phải được Cục An toàn Thực phẩm cấp số tiếp nhận bản công bố sản phẩm trước khi bán ra thị trường. Nhãn TPCN bắt buộc ghi câu: “Sản phẩm này không phải là thuốc và không có tác dụng thay thế thuốc chữa bệnh”, kèm thông tin về thành phần, công dụng và đơn vị sản xuất.

How to Differentiate Drugs and Dietary Supplements by Their Registration Numbers
💊 Drugs are products used for treating, preventing, and diagnosing diseases. Before being marketed, they must be evaluated and granted a Marketing Authorization Number (MA Number) by the Drug Administration of Vietnam (DAV) under the Ministry of Health. This number confirms the product’s legality and origin.
Common MA number formats include: VN-######-xx (domestically manufactured drugs), VD-######-xx (prescription drugs), or other similar structures depending on the product type.
👉 Dietary supplements (functional foods) support health but do not have therapeutic effects. These products must obtain a Product Self-Declaration Receipt Number from the Vietnam Food Administration (VFA) before circulation. The product label must include the mandatory statement: “This product is not a medicine and is not intended to replace medical treatments”, along with ingredient lists, intended use, and manufacturer information.
Common formats of declaration numbers include: Serial number / Year / ATTP-TNCB, ATTP-XNCB, or ĐKSP.

🏥 Những điểm thay đổi quan trọng trong Dự thảo Thông tư của Bộ Y tế về phân cấp quản lý thiết bị y tế
Bộ Y tế ban hành dự thảo Thông tư quy định phân cấp thực hiện thủ tục hành chính và ban hành hệ thống mẫu biểu mới trong quản lý thiết bị y tế
Trong đó, Bộ Y tế phân cấp cho Cục Hạ tầng và Thiết bị y tế giải quyết một số thủ tục quan trọng, gồm:
- Cấp mới số lưu hành cho thiết bị y tế loại C, D.
- Kiểm tra sau cấp số lưu hành đối với thiết bị loại C, D.
- Đình chỉ, chấm dứt đình chỉ và thu hồi lô thiết bị y tế không bảo đảm chất lượng.
- Cấp giấy phép nhập khẩu thiết bị y tế.
- Cấp/Cấp lại/Thu hồi Giấy chứng nhận lưu hành tự do (CFS) đối với thiết bị loại C, D.
- Cấp và thu hồi chứng nhận đăng ký hoạt động kiểm định theo Điều 56 Nghị định 98/2021/NĐ-CP.
- Kiểm tra chuyên ngành: phân loại, sản xuất, lưu hành, xuất nhập khẩu, quảng cáo, sử dụng TBYT tại các cơ sở y tế.
Ban hành kèm theo Thông tư này mẫu văn bản, báo cáo phục vụ hoạt động quản lý thiết bị y tế thay thế hoàn toàn hệ thống mẫu của Thông tư 19/2021/TT-BYT.

🏥 Key Updates in the Draft Circular of the Ministry of Health on Decentralizing Medical Device Management
The Ministry of Health has released a draft Circular detailing the decentralization of administrative procedures and the issuance of a new set of templates for medical device management.
Accordingly, the Ministry delegates several critical procedures to the Infrastructure and Medical Device Administration, including:
- Issuance of new circulation numbers for Class C and D medical devices.
- Post-market review following the issuance of circulation numbers for Class C and D devices.
- Suspension, lifting of suspension, and recall of medical device batches that fail to meet quality standards.
- Issuance of import licenses for medical devices.
- Issuance/Re-issuance/Revocation of Certificates of Free Sale (CFS) for Class C and D devices.
- Issuance and revocation of certificates of registration for conformity assessment bodies in accordance with Article 56 of Decree 98/2021/NĐ-CP.
- Specialized inspections covering device classification, manufacturing, distribution, import–export, advertising, and use of medical devices at healthcare facilities.

The Circular also introduces a new set of forms and reporting templates, fully replacing those under Circular 19/2021/TT-BYT.

📌[Englishbelow] Dự thảo Thông tư phân nhóm thiết bị y tế trong đấu thầu tập trung: Những điểm mới và cơ hội cho doanh nghiệp📈

Bộ Y tế ban hành Dự thảo Thông tư hướng dẫn phân nhóm thiết bị y tế (TBYT) theo tiêu chuẩn kỹ thuật và chất lượng, dự kiến áp dụng từ ngày 01/01/2026. Đây là bước quan trọng nhằm chuẩn hóa các yêu cầu trong mua sắm, đấu thầu và tăng tính minh bạch trên thị trường TBYT.

1. Nguyên tắc phân nhóm

Thiết bị y tế được phân nhóm dựa trên hai tiêu chí trọng tâm:

🔹 Tiêu chuẩn kỹ thuật:
Thiết bị phải có văn bản đánh giá sự phù hợp tiêu chuẩn kỹ thuật do tổ chức được ILAC, IAF hoặc MDSAP công nhận.

🔹 Chất lượng thiết bị:
Yêu cầu giấy phép lưu hành hoặc CFS từ Bộ Y tế Việt Nam hoặc các cơ quan uy tín như FDA (Hoa Kỳ), TGA (Úc), PMDA/MHLW (Nhật Bản), Health Canada, cơ quan quản lý EU/Anh/Thụy Sĩ, MFDS (Hàn Quốc), NMPA (Trung Quốc).

2. Ba nhóm phân loại trong đấu thầu

Nhóm 1: Yêu cầu đồng thời tiêu chuẩn kỹ thuật và giấy phép lưu hành từ quốc gia/tổ chức tham chiếu.

Nhóm 2: Chỉ yêu cầu tiêu chuẩn kỹ thuật.

Nhóm 3: Chỉ yêu cầu giấy phép lưu hành.

Chủ đầu tư có thể tự phân nhóm, thuê tổ chức độc lập hoặc thành lập hội đồng chuyên môn; bảo đảm công khai, minh bạch và phù hợp với nhu cầu chuyên môn.

💡Hệ thống phân nhóm mới giúp chuẩn hóa tiêu chí kỹ thuật, tăng tính cạnh tranh, hạn chế tiêu chí bất hợp lý và giảm rủi ro trong quá trình đấu thầu. Đối với doanh nghiệp, đây là cơ hội nâng cao năng lực cạnh tranh, đặc biệt đối với sản phẩm sản xuất trong nước có chứng nhận quốc tế như CE, FDA, ISO.
Thông tư khi được ban hành kỳ vọng tạo nền tảng pháp lý đồng bộ, thúc đẩy thị trường thiết bị y tế phát triển minh bạch, bền vững và nâng cao hiệu quả đầu tư trang thiết bị tại các cơ sở y tế.

The Ministry of Health is finalizing a Draft Circular guiding the classification of medical devices based on technical standards and quality criteria, expected to take effect on January 1, 2026. This Circular aims to standardize procurement requirements, enhance transparency, and strengthen the regulatory framework for medical device selection in healthcare facilities.

1. Classification Principles

Medical devices are classified based on two primary criteria:

🔹 Technical Standards:
Devices must obtain a certificate of conformity issued by an assessment body accredited by ILAC, IAF, or MDSAP.

🔹 Quality Requirements:
Devices must hold a Market Authorization or Certificate of Free Sale (CFS) issued by the Ministry of Health of Viet Nam or reputable regulatory authorities such as FDA (USA), TGA (Australia), PMDA/MHLW (Japan), Health Canada, EU/UK/Swiss authorities, MFDS (Korea), or NMPA (China).

2. Three Classification Groups for Bidding

Group 1: Devices required to meet both technical standards and market authorization from referenced countries/organizations.

Group 2: Devices required to meet technical standards only.

Group 3: Devices required to hold market authorization only.

Project owners may conduct the classification themselves, engage an independent organization, or establish a professional evaluation council, ensuring transparency, objectivity, and alignment with clinical and financial needs.

3. Implications and Opportunities

💡The new classification framework contributes to standardizing technical criteria, improving competitiveness, reducing unreasonable specifications, and mitigating risks during the bidding process. For enterprises, it creates opportunities to enhance competitiveness—particularly for domestically manufactured products with international certifications such as CE, FDA, or ISO.

🔷Thông tư 40/2025/TT‑BYT được Bộ Y tế ban hành, thay thế hoàn toàn Thông tư 07/2024/TT‑BYT nhằm hoàn thiện hành lang pháp lý về đấu thầu thuốc tại các cơ sở y tế công lập.
Với quy định rõ hơn về phân nhóm gói thầu, quản lý nguồn vốn và thủ tục lựa chọn nhà thầu, văn bản mới hướng tới đảm bảo cung ứng thuốc và ổn định giá thuốc.
Thông tư có hiệu lực thi hành từ ngày 25 tháng 10 năm 2025.
