Many parents cannot resolve custody disputes because they cannot solve the individual or interpersonal conflicts brought about by their marital distress, separation, and divorce. Thus, negotiating a child custody agreement is as much a psychological task as a legal one. While emotional distress greatly complicates negotiating a custody agreement, it is conversely true that resolving custody and other legal issues is an essential step toward abandoning past conflicts and redefining future family relationships (R. Emery).
