- Medical Error
A mistake that may occur despite reasonable care.
Healthcare is complex, and not all complications are preventable.

An error does not automatically mean legal liability.

- Medical Negligence
Occurs when the standard of care expected from a reasonably competent practitioner is not met.

Courts typically assess:
• Was there a duty of care?
• Was that duty breached?
• Did the breach cause harm?
• Was the harm foreseeable?

If all four are proven, negligence may be established.
