Under Section 125 of the Health Professions Act (Chapter 27:19), it is a criminal offense for any unregistered individual to practice for gain, pretend to be, or use the protected title of Dispensing Optician or Optician. This prohibition extends to the use of any symbols or descriptions that falsely imply professional registration or the possession of a relevant degree. Violators face severe penalties, including a Level 10 fine, up to five years imprisonment, or both.
